建构老年人刑事特别保障制度初探

I 中文提要 刑事领域中受犯罪行为侵害的老年人和实施犯罪的老年人的权益是当前老年 人这一弱者群体中极易被社会忽视的，对他们的保护无论立法、司法都显得相对 滞后，应该引起广泛关注。本文从介绍我国目前老年人权益保护的法律体系入手， 指出了当前刑事法律规定对老年受害人和老年犯罪人权益保护的不足，从敬老习 俗、道义功利的理论角度加以分析后认为，应该在确立老年人利益优先保护原则 的前提下，对刑事领域中被侵害的老年人和犯罪的老年人权益进行特别保护，并 提出了我国受害老年人和犯罪老年人刑事特别保护体系的制度设想。 关键词：老年人刑事特别保障制度建构 作者：杜平 II 指导老师：于晓琪 On Constructing the Criminal Special Assurance System of the Aged People Abstract In the criminal fieldthe rights and interests of the aggrieved aged people in the ， criminal acts and the aged criminals are easy to be ignored in the present aged weak peopleand the protection of them seems lagged behind either in legislation or justice. ， We should pay more attention to this problem.By analyzing China’s present Law system in the protection for the rights and interests of the agedthe thesis points out the ， deficiencies in the protections for the aged people who was aggrieved and aged criminal in the present criminal field.After analyzing the habitude of respecting the aged and the choice for morality and justiceutilityetc.it concludes that we should make special ，，， protection for the rights and interests of the aggrieved and criminal aged people in the criminal field by establishing the priority protection principle for the rights and interests of the aged people.Andthis thesis assumes how to construct acriminal special ， protection system for the aggrieved and criminal aged people in China.
