Forpersonaluseonlyinstudyandresearch;notforcommercialuse 中华人民共和国治安管理处罚条例（中英对照） 薂 RegulationsofthePRConAdministrativePenaltiesforPublicSecurity 蝿 第一条为加强治安管理，维护社会秩序和公共安全，保护公民的合法权益，保障社会主义现代化建设的顺利进行，制定本条例。 螇 Article1.TheseRegulationsareformulatedforthepurposeofstrengtheningtheadministrationofpublicsecurity,maintainingsocialorderand publicsafety,protectingthelawfulrightsofcitizensandguaranteeingthesmoothprogressofthesocialistmodernization. 芇 第二条扰乱社会秩序，妨害公共安全，侵犯公民人身权利，侵犯公私财产，依照《中华人民共和国刑法》的规定构成犯罪的，依法 追究刑事责任；尚不够刑事处罚，应当给予治安管理处罚的，依照本条例处罚。 节 Article2.Whoeverdisturbssocialorder,endangerspublicsafety,infringesuponacitizen'srightsofthepersonandencroachesuponpublicor privateproperty,ifsuchactsconstituteacrimeaccordingtotheCriminalLawofthePeople'sRepublicofChina,shallbeinvestigatedforcriminal responsibility;ifsuchactsarenotseriousenoughforcriminalpunishmentbutshouldbegivenadministrativepenaltiesforpublicsecurity,penalties shallbegivenaccordingtotheseRegulations. 螁 第三条在中华人民共和国领域内发生的违反治安管理行为，除法律有特别规定的以外，适用本条例。 腿 Article3.TheseRegulationsshallapplytoactsviolatingtheadministrationofpublicsecuritywithintheterritoryofthePeople'sRepublicof China,exceptwhenotherwisestipulatedbylaw. 蚆 在中华人民共和国船舶或者航空器内发生的违反治安管理行为，也适用本条例。 肃 TheseRegulationsshallalsoapplytoactsviolatingtheadministrationofpublicsecurityaboardshipsorairbornevehiclesofthePeople'sRepublic ofChina. 薈 第四条公安机关对违反治安管理的人，坚持教育与处罚相结合的原则。 芈 Article4.Indealingwiththosewhoviolatetheadministrationofpublicsecurity,publicsecurityorgansshalladheretotheprincipleofcombining educationwithpunishment. 肅 第五条对于因民间纠纷引起的打架斗殴或者损毁他人财物等违反治安管理行为，情节轻微的，公安机关可以调解处理。 螃 Article5.Actscausedbycivildisputeswhichviolatetheadministrationofpublicsecurity,suchasbrawlinganddamagingordestroyinganother person'sproperty,iftheadverseeffectsareminor,maybehandledbypublicsecurityorgansthroughmediation. 虿 第二章处罚的种类和运用 莆 CHAPTERIITYPESANDAPPLICATIONOFPENALTIES 薅 第六条对违反治安管理行为的处罚分为下列三种： 薄 Article6.Penaltiesforactsviolatingtheadministrationofpublicsecurityaredividedintothreetypesasfollows: 螁 （一）警告。 螈 (1)warning; 羄 （二）罚款：一元以上，二百元以下。本条例第三十条、第三十一条、第三十二条另有规定的，依照规定。 芄 (2)fine,rangingfromaminimumofoneyuantoamaximumoftwohundredyuan.IncaseswhereArticles30,31and32intheseRegulations
